Article 1 : Introduction
The present terms of sale are concluded on one hand by the company Purebike.fr. with a capital of 37000 euro ( wich head office is based at 5 Rue de l'Eglise Saint Martin 79400 Saint Maixent l'Ecole ) registered in the register of companies of Niort under the number 492 645 981 00019 below mentioned as " purebike.fr " and on the other hand, by every physical or moral person wishing to proceed or purchase via the web site of " purebike.
The present terms of sale are defining the contractual relations between purebike.fr and the buyer (whatever his origin : professional or consumer ), and the conditions applicable to any purchase realized via the website Purebike.fr.
The acquisition of the goods or the services through the present site implies an unconditional acceptance by the buyer of the present terms of sale.
These terms of sale will prevail over any other general or particular conditions not expressly approved by purebike.fr.
Purebike.fr is allowed to modify his terms of sale at any time. In that case, the applicable conditions will be the ones current in the date of the client's order.

Products and offered services are the ones which appear in the catalog published in the site of purebike.fr
They are proposed in the limit of the available stock
Every product go with a description of the supplier and for some of them, with the mention PDF in order that the buyer have access to the documentation.
The photos of the catalog are the most faithful possible but are not contractual, and there can be some differences between the product shown and the product delivered ( like colours ).
If a supplier modifies a product, the graphic representation of this one would not engage the responsibility of Purebike and wouldn't affect the validity of the sale.
Any incompatibility between products bought on the site purebike.fr and products in ownership of the buyer would not fall to purebike.fr and would not be a case for repayment. The buyer has to refer to the salesman if he does not have enough technical knowledge in order to have confirmation of the field of use or the compatibility of the products he plan to buy.
The prices that appear in the catalog are prices in euro and include the applicable VAT at the day of the order. Any change of rate can be echoed on the prices of products and services.
Purebike.fr can modify his prices at any time, being however understood that the prices that appear in the catalog in the daytime of the order will be the only one applicable to the buyer.
The indicated prices do not include the shipping and delivery costs. These costs are notified to the buyer at the time of the validation of his basket and are generally a 10€ unit cost for France
The products shown in the website are reserved for the buyers who live inside EU, Switzerland , UK and Andorra.
The buyer, who wishes to buy a product or a service necessarily has to :
– Fill the index form of identification onto which he will indicate all the needed informations, or give his client login if he has one
– Fill the on-line order form by giving all the references of products or chosen services
– Validate his(her) order having verified it before
– Make the payment in the planned conditions
– Confirm his(her) order and its payment
The confirmation of the order entails acceptance of the present terms of sale, the recognition to have completed its knowledge and the renunciation to take advantage of its own conditions of purchase or of any other conditions.
All the supplied data and registered confirmation will be worth proof of the transaction. The confirmation will be worth signature and acceptance of the made operations.
The salesman will communicate by e-mail the confirmation of the registered order.
The buyers, not professional or physical persons, benefit from a legal delay of retraction of seven days as from the delivery of the order to return of the product for exchange or repayment without penalty, exept the return shipping charges. For any return of product in due time, the buyer will however have to send first an e-mail to puresav@purebike.fr in order to obtain a return authorization number. This return number guarantees the follow-up of the product and its repayment. Any product returned without return authorization number will be refused.
The product must be returned into its original packaging and state, and must be accompanied with the possible documentations and accessories supplied at its delivery. Any breach of this obligation will involve a non repayment.
The repayment of one or several products returned in the legal delay will be done by transfer on credit card, by check, or as purchase voucher in purebike.fr.
The price is due for any order.
Payments will be done by credit cards and will be realized by means of the secured system Mercanet who uses the SSL (Secure Socket Layer) protocol so that the information given is coded by a software and so that no third party can access to this during the payment.
The buyer account is sold as soon as the order is validated by Purebike. Any payment not validated by the bank or recognized as deceitful will automatically cancel the order.
At the request of the buyer, an invoice including the VAT can be sent to him(her).
In order to fight against the internet fraud and to proceed various checks your informations can be communicated to a third party.

Deliveries are made to the address indicated in the order form and they can only be agreed for the valid geographical zone.
In case of partial availability of the articles ordered , purebike.fr can separate the order and send the available articles to the buyer and then, balancing the remaining article to a future delivery. In this case the remaining articles will be free shipped.
The risks are chargeable to the buyer as from the products have been shipped from Purebike's office.
In case of damage during the transport, a motivated protest must be formulated to the carrier within three days as from the delivery.
The delivery informations are given only as a rough guide and they cannot be a reason of cancellation of the order or quite other complaint. If the delivery delay overtake thirty days as from the order, the sale contract can be cancelled and goods shipped another time. The buyer , in this case, can also ask for a repayment of the original order.
The deliveries will be made via colissimo "french post" or via Chronopost, and the indicative delays of delivery are on average from 3 to 5 working days.

All the products supplied by the salesman benefit from the legal guarantee foreseen by articles 1641 and following ones of the Civil code
In case of non corrispondance of a sold product, the buyer can return it to Purebike and ask for an exchange or a repayment. If the product sold by purebike.fr requires a warranty for repair or exchange, Purbike.fr will deal with its suppliers who are the only one to be abble to judge if the product can be taken under warranty or no.
In any case if the buyer need to send back his product to purebike.fr for warranty, he will beforehand have to contact Purebike.fr by e-mail at puresav@purebike.fr in order to obtain a Return Authorization Number.
Products warranties do not cover articles like brake blocks, Pads, Tire, and the warranty will be refused if there has been an intervention on the product by the buyer ; by any unapproved third party ; or if the article has not been used into its limited conditions
Purebike's responsibility cannot be engaged for a damage resulting from the use of the Internet network such as loss of data, intervention, virus, break of the service, or other involuntary problems. More over any incompatibility between products bought on the website purebike.fr and products in the ownership of the buyer would not fall to purebike.fr and would not to be the object of a repayment.
All the elements of the website purebike.fr are and remain the intellectual and exclusive property of purebike.fr.
No one is authorized to reproduce, to exploit, to rerun, or to use whatever title it is, even partially,the elements of the website.
Any simple link or hypertext link is strictly forbidden if Purebike.fr has not given its authorization before.
According to the law relative to the computing, to the files and to the liberties of January 6th, 1978, the nominative informations relative to the buyers can be the object of an automatic data processing
Purebike.fr has the right to collect information on the buyers including by using cookies, and, if he wishes it, to give to commercial partners the collected informations.
The buyers can oppose to the disclosure of their informations by indicating it to purebike.fr. The users also have the right to access and rectificate the data concerning them, according to the law of January 6th, 1978.
The automatic data processing, including the clients e mail management was the object of a statement to the CNIL
Purebike.fr will archive order forms and invoices on a reliable and durable support establishing a faithful copy according to provisions of the article 1348 of the Civil code
Computerized registers of purebike.fr will be considered by the parties as proof of the communications between them .
The present on-line terms of sale are subjected to the French law.
In case of dispute, competence is awarded to the competent courts of Niort.
